Terms and Conditions

These Terms and Conditions (“Terms”) apply to use of the Nosibele Design & Embroidery website and to quotation requests made through it. They are a practical draft for a quotation-based embroidery, branding, printing and clothing business and should be reviewed by the business owner. They do not replace a signed order confirmation or invoice terms once an order is accepted.

Website use

You may browse this website for lawful purposes. You must not attempt to disrupt the site, misuse forms, scrape content at scale, or submit unlawful or abusive material.

Products and services

We offer embroidery, printing, branded clothing and related apparel services as described on the website. Product images and descriptions are illustrative. Final goods are made to order according to the agreed specification.

Quotations

Website prices marked “from” or “price on enquiry” are guides only in South African rand. Prices are quoted in South African rand. VAT will only be charged where legally applicable and shown on the quotation. A quotation is prepared after we understand quantity, garment, artwork, placement, colours and timeline. Submitting a form is a request for a quotation, not an accepted order.

Quote validity

Unless a quotation states otherwise, a quote remains open for a reasonable period for discussion. Pricing and timing may change if materials, artwork or requirements change, or if there is delay before acceptance.

Deposits and payments

Order payment rules are set out in the Quotation & Order Terms and Cancellation and Refund Policy. In summary: a quotation is not an accepted order; a 50% deposit is required before production begins (higher or full payment may be required for urgent, large or high-upfront-cost work); the remaining balance is payable before collection or delivery; finished work may be withheld until the balance is paid. Do not send card details through the website form. Payment methods are confirmed on the quotation or invoice.

Artwork approval

Before production of custom work, we may ask you to approve artwork, spelling, sizing, placement and colours. Production proceeds on the approved version. You may attach PNG, JPG or PDF artwork on the website quotation form; attachments travel with that quotation request to our quotes mailbox. You must have the right to use any logo, brand, image, name or design you supply. We may reject unsafe, corrupted or unsupported files.

Customer responsibility for spelling, sizing, colours and design approval

You are responsible for checking names, numbers, logos, sizes, colour choices and design details before approving artwork. You also confirm that artwork you upload or send does not infringe another person’s intellectual property or other rights. Changes requested after approval may affect price and lead time.

Production lead times

Typical turnaround is discussed at quotation stage and depends on quantity, technique, stock and current studio workload. Stated times are estimates unless confirmed in writing for a specific order.

Delays

We will communicate material delays where practical. Delays may arise from late artwork approval, customer-supplied materials, third-party courier issues, power interruptions, or material shortages.

Personalised goods

Most Nosibele products are personalised or made to your specification. Personalised goods are generally not suitable for change-of-mind returns once production has started or been completed.

Cancellation

See the Cancellation and Refund Policy. You may cancel a quotation request before accepting a quotation and paying a deposit. After deposit and/or artwork approval, cancellation may not be possible for work already started, or may involve charges for committed materials and labour. We do not promise automatic refunds for customised work.

Returns and refunds

Because goods are typically custom-made, change-of-mind returns are limited. If an item has a production defect or material departure from the approved specification, contact us promptly with photos and order details so we can assess repair, remake or another fair remedy. Nothing in these Terms is intended to exclude rights you may have under the Consumer Protection Act or other South African law where those rights apply.

Defective work

Please inspect goods on collection or delivery. Notify us of suspected defects as soon as reasonably possible so we can investigate.

Screen and colour variations

Colours on screens, printers and fabric can differ. Embroidery thread and dye-sublimation results may vary slightly from on-screen proofs. We aim for a commercially reasonable match to approved artwork.

Customer-supplied garments

If you supply garments for branding, please ensure they are suitable for the chosen process. We take reasonable care, but risk in customer-supplied stock should be discussed before work begins, especially for delicate or previously worn items.

Customer-supplied artwork

You must have the right to use any logo, brand, image, photograph, name or design you submit. You are responsible for obtaining permissions from brand owners or rights holders.

Intellectual-property responsibility

Original website copy, layout, graphics, and Nosibele-owned artwork or photographs are protected by intellectual-property law. Third-party logos and materials remain the property of their owners. Access to this website does not grant permission to copy content for commercial use without written permission. Nosibele may refuse artwork that appears unlawful, infringing, defamatory or otherwise inappropriate.

Unlawful or prohibited material

We may decline work that promotes unlawful activity, hate, or clear intellectual-property infringement.

Third-party links

Links to WhatsApp, social platforms, maps or other sites are provided for convenience. We are not responsible for their content or availability.

Website availability

We aim to keep the website available, but do not guarantee uninterrupted access. Maintenance, hosting issues or force majeure events may affect availability.

Reasonable limitation of liability

To the extent permitted by law, Nosibele is not liable for indirect or consequential loss arising from website use or quotation discussions. For orders, our responsibility is limited to reasonable repair, remake or refund remedies related to defective custom work we produced, subject to the facts of the order and applicable law. We do not exclude liability that cannot lawfully be excluded.

South African law

These Terms are governed by the laws of the Republic of South Africa.
